THESE TERMS AND CONDITIONS OF USE (“T&C”) GOVERN YOUR (“USER” OR “YOU”) ACCESS TO AND USE OF THE WEBSITE. THE WEBSITE IS AVAILABLE FOR YOUR USE ONLY UPON YOUR AGREEING TO THESE T&Cs. IF YOU DO NOT AGREE TO ALL OF THE T&Cs HEREIN, PLEASE DO NOT USE THE WEBSITE. BY USING THE WEBSITE, YOU SIGNIFY YOUR AGREEMENT TO BE BOUND BY THESE T&Cs.

Bravo Build Company (“BBC”) reserves its rights to amend these T&Cs from time to time without notice. Your continued use of the Website subsequent to the posting of amendments to these T&Cs shall constitute acceptance of such T&C as amended.

1. Accounts and Registration.

In the event you elect set up a user account (the “Account”), you will need to provide a password, username, and other information such as your name and email address. You are solely responsible for keeping your Account information confidential. You may not transfer, sell, assign, or sublicense your Account to any third party without our prior written approval. You are solely responsible for all usage or activity on the Website that occurs under your Account, including, but not limited to, use of the Website by any person who uses the Account, with or without authorization. You agree to notify BBC immediately of any unauthorized use or any other breach of security on your Account. BBC will not be liable for losses incurred as a result of an unauthorized use of a password or account. Personal information submitted through the Website is governed according to BBC’s Privacy Policy.

1. Transactions.

BBC reserves the right to refuse or cancel any order you place on the Website. BBC reserves the right to limit quantities on orders placed by the same Account, on orders placed by the same method of payment, and on orders that use the same billing or shipping address. BBC reserves the right to, in our sole discretion, prohibit purchases of any products to resellers, dealers, and distributors.

If you wish to purchase any product made available through the Website, you may be asked to supply certain information relevant to your transaction including, without limitation, information about your method of payment (such as your payment card number and expiration date), your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT CARDS OR OTHER PAYMENT METHODS UTILIZED IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to BBC the right to provide such information to third parties for purposes of facilitating the transactions initiated by you or on your behalf.

You agree to pay all charges that may be incurred by you or on your behalf through the Website, at the prices in effect when such charges are incurred and you authorize us to charge all sums for the orders that you make to the payment method specified at the time. In addition, you remain responsible for any taxes that may be applicable to your transactions. You authorize us to charge all applicable amounts for the orders that you make to the payment method specified at the time of purchase.

The Website may include links to other websites maintained by third parties ("Linked Sites"). BBC provides Linked Sites to you solely as a convenience, and the inclusion of Linked Sites does not imply endorsement of the Linked Sites by BBC. You access Linked Sites at your own risk and by accessing them you leave the Website. Linked Sites are not under the control of BBC and BBC is not responsible for the contents of any Linked Site.

1. Termination.

These T&Cs constitute an agreement that is effective unless and until terminated by BBC. BBC may, at its sole discretion, terminate these T&Cs, or suspend or terminate your access to the Website, at any time for any reason or no reason, with or without notice. You may terminate your Account at any time by contacting BBC customer service. If in BBC’s sole discretion you fail to comply with any term or provision of these T&Cs, BBC may terminate your Account and deny you access to the Website. In the event of denial of access by BBC, you are no longer authorized to access the Website. Upon termination of these T&Cs: (a) you must immediately cease use of the Website; (b) you will no longer be authorized to access your Account or the Website; and (c) the following Sections will survive termination: Sections 6, 7, and 8.

1. No Waiver.

The waiver of any provision of these T&Cs shall not be considered a waiver of any other provision or of BBC’s right to require strict observance of each of the terms herein. If any provision of these T&Cs is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.

1. Limitations on Liability.

All products offered for sale through the Website are so offered “as is” and are, accordingly, purchased by User as such. BBC does not guarantee that such products will meet User’s expectations. BBC does not make any express or implied warranty of fitness of products sold through the Website for a particular purpose. BBC further does not make any express or implied warranties of merchantability with respect to products sold through the Website. Consistent with the foregoing, BBC does not warrant the accuracy of any information contained in any of the products sold. No information provided in any product sold through the Website is intended to serve as a substitute for applicable federal regulations or other appliable governmental laws or regulations. BBC accepts no liability for the content provided, or the consequences of any actions taken on the basis of the information provided.

By using the Website, except as otherwise provided for herein, you agree to waive any claim that you may have against BBC and its agents, servants, employees, contractors, officers, managers, representatives, successors, assigns, subsidiaries, and/or affiliates for any alleged injury sustained as a result of your reliance upon materials purchased through the Website. Should you bring any claim in violation of this Agreement, you agree that you shall be liable to all defending parties for any and all reasonable attorneys’ fees and other expenses incurred in defending against any such claims.

Consistent with the foregoing, BBC shall not be held liable for any harm caused by any computer virus or spyware, or for any device damage, should such be incurred due to using or accessing the Website.

Should any scenario arise whereby BBC is held liable for monetary damages for injuries sustained by User due to User’s use of the Website, the Parties agree that any such liability shall not exceed the amount that the User has expended on the purchase immediately before the alleged damage occurred.

1. Governing Law and Jurisdiction.

These T&Cs shall be construed in accordance with the laws of the State of Oklahoma without regard to any conflict of laws provisions. Resolution of any and all disputes related to this Agreement shall be in the state or federal courts within the State of Oklahoma.

1. Intellectual Property Rights.

BBC expressly reserves all copyrights and all other intellectual property rights in all content offered through, or residing on, the Website. Such rights are owned solely by BBC. Neither anything herein, nor any other communications and/or activity on the part of BBC, shall be construed as a grant of any exclusive rights to such content. Further, to the extent that BBC extends to User a non-exclusive license to use such content, such license shall at all times remain revocable in the sole discretion of BBC.

Products offered for sale by BBC are so offered for User’s own personal use. Copies may not be provided to others. These products may not be shared or claimed as your own and may not be used to create derivative products for sharing or selling.

The delivery of any products by BBC shall not constitute a transfer of any commercial or promotional use rights in such products. Any downloading or exporting capabilities are solely an accommodation to you and shall not constitute a grant, waiver, or other limitation of any of BBC’s rights.

Although, as a convenience, we do not limit the number of downloads from the Website, we monitor user downloads and reserve the right to revoke access to BBC’s on-line publications without a refund if they are being shared by User with third-parties.
